(01/17/23 UPDATE): On 01/13/2023, WDD stood before a NYS Supreme Court Judge petitioning to extend our deadline to file an Article 78 Proceeding and to extend the Order of Remedy put in place by the Village of Dryden. The Judge ruled to allow for the Article 78 Proceeding to be extended (yay!) but also ruled to not extend the Order to Remedy (boo!) effectively ceasing operations of WDD at 1 Tannery Circle. However, we are not entirely closed! We have converted to conducting home visits in lieu of daycare! To learn more about our new services and procedures email us at admin@wildesdoggydaycare.com
(12/14/22 UPDATE): WDD's NYS Supreme Court Article 78 Proceeding is in process and has been assigned a supreme court judge to the case. Our first of several hearings in this process is scheduled in the new year. Again, business is still operating as normal due to the continuance of business being upheld by the court while the matter is resolved.
(10/05/22 UPDATE): After the ZBA hearing on 10/04/22, the board determined that dog daycares are NOT customary home occupations. However, we do not agree with this result and we will be appealing it to the Tompkins County Court. Business is still operating as normal due to WDD's action to appeal the ZBA decision.
(09/25/22 UPDATE): As of 09/24/2022 it has been announced that the ZBA hearing that will discuss the allowance of dog daycares as CHOs in Dryden, NY will be on 10/04/2022 at 7:00PM at the Neptune Hose Hall, 26 North St. Dryden, NY. This hearing is open to the public! This means that if you have the time, come on out to show your support for WDD! You can prepare a statement or just come in support. If you would like to prepare a statement, please let us know by emailing us at admin@wildesdoggydaycare.com.
(ORIGINAL POST): As of 08/03/2022 Wildes Doggy Daycare was issued a violation of Dryden Zoning Laws and was notified to cease business. Wildes Doggy Daycare is able to legally take dogs into our home for top notch care due to a legal definition called a "Customary Home Occupation" (CHO). This CHO is the legal definition that allows doctors and vets to have medical and veterinary practices in their home. We were issued the violation because currently there is no Tompkins County precedent stating that dog daycares are valid CHOs! However, we are not giving up! We have a few course of options we can take, one of them being going to court to establish a dog daycare as a valid CHO in Tompkins County. We are confident we will win our case because WDD satisfies all of the conditions of a CHO! Furthermore, at-home child daycares are considered valid CHOs, so why not dog daycares!? They are our babies too! We currently have an appeal filed that allows us to continue business while we wait for the Zoning Board of Appeals (ZBA) hearing.
We will keep you all updated as the story develops.
